דוד קרצמר

דוד קרֶצמֶר (נולד ב-4 בנובמבר 1943 ביוהנסבורג, איחוד דרום אפריקה) הוא משפטן ישראלי, פרופסור אמריטוס למשפטים באוניברסיטה העברית בירושלים, מומחה למשפט בינלאומי ומשפט חוקתי ובמיוחד לזכויות אדם. הוא ממייסדי "בצלם" ויו"ר הנהלתה לשעבר וחבר המועצה הציבורית שלה, ממייסדי "האגודה לזכויות האזרח" ויו"ר הנהלתה לשעבר, וכן ממקימי מרכז מינרבה לזכויות אדם באוניברסיטה העברית בירושלים ובאוניברסיטת תל אביב.

ביוגרפיה

קרצמר נולד בשנת 1943 בעיר יוהנסבורג שבדרום אפריקה. בשנת 1963 עלה לישראל.

קריירה אקדמית

קרצמר השלים את לימודי התואר הראשון (1967) והשני (1972) במשפטים בפקולטה למשפטים של האוניברסיטה העברית. את תואר הדוקטור קיבל באוניברסיטת יורק שבקנדה. הוא התמחה אצל השופט צבי ברנזון בבית המשפט העליון וכן במשרד עו"ד יגאל ארנון, ובשנת 1968 קיבל רישיון עורך דין.

קרצמר החל ללמד כמרצה בפקולטה למשפטים באוניברסיטה העברית ב-1969. לאחר לימודי הדוקטורט הוא התמנה כמרצה בפקולטה זו, וקיבל את קתדרת לואי מרשל באיכות הסביבה. הוא קודם לדרגת מרצה בכיר ב-1978. מ-1981 עד 1984 הוא כיהן כסגן דיקן לענייני סטודנטים בפקולטה למשפטים. ב-1984 הוא מונה לפרופסור חבר, וב-1991 מונה לפרופסור מן המניין. כיום הוא פרופסור אמריטוס. הוא קיבל מינוי גם בבית הספר למדיניות ציבורית בפקולטה למדעי החברה והחזיק בקתדרת ברוס ויין למשפט בין לאומי עד 2006.

במהלך השנים כיהן קרצמר כמרצה אורח באוניברסיטת דרום קליפורניה, טוליין, קולומביה, MIT, בבית הספר ללימודי משפט מתקדמים בלונדון, מכון מקס פלנק למשפט משווה וזר בהיידלברג, ואוניברסיטת אלסטר בצפון אירלנד [1]. כיום הוא חבר סגל במכללת ספיר.

ב-1993 הקים קרצמר את מרכז מינרבה לזכויות אדם המשותף לאוניברסיטה העברית בירושלים ולאוניברסיטת תל אביב ובשנים 1997–2000 כיהן כמנהל האקדמי הראשון שלו. ב-2010 הקים מרכז מינרבה לזכויות אדם בירושלים מלגת מחקר בדיני זכויות אדם לזכר אשתו המנוחה של קרצמר.

תחומי העיסוק של קרצמר הם דיני זכויות אדם, משפט חוקתי ומשפט הומניטרי, וכן ביקורת שיפוטית. הוא לימד דיני נזיקין, חוזים, משפט חוקתי ומנהלי, דיני זכויות אדם במשפט הבין לאומי ומשפט הומניטרי.

קרצמר פרסם ספרים ומאמרים אודות מידת ההגנה שמספק בית המשפט העליון לזכויות אדם, על מעמדם המשפטי של ערביי ישראל, על חופש הביטוי וביטויים גזעניים, על זכות ההפגנה, על ביקורת שיפוטית ועל מושג כבוד האדם בשיח זכויות האדם, על תחולת אמנת ז'נבה בשטחים שכבשה ישראל במלחמת ששת הימים ועל נושאים נוספים.

פעילות חברה אזרחית

קרצמר נמנה עם מקימי "האגודה לזכויות האזרח" ב-1972 וכיהן כיו"ר ההנהלה וחבר מועצת המנהלים שלה. קרצמר היה בין מקימי "בצלם" ובעבר כיהן כיו"ר הארגון. כיום הוא חבר במועצה הציבורית של הארגון.

קרצמר חבר בשורה של גופים בינלאומיים העוסקים בזכויות אדם. בין היתר היה בשנים 1995–2002 חבר בוועדת המומחים המפקחת על האמנה הבינלאומית בדבר זכויות אזרחיות ומדיניות, וכיהן כסגן היו"ר של הוועדה בשנים 2001–2002.

קרצמר הוא חבר בפורום המרצות והמרצים למשפטים למען הדמוקרטיה, הפועל נגד השינויים שהוצעו במערכת המשפט בשנת 2023.
