בשנת [[1995]] ביטל בית המשפט העליון של ארצות הברית [[חוק פדרלי]] האוסר על נשיאת נשק בקרבת בתי ספר, במסגרת [[פסק דין ארצות הברית נגד לופז]] (514 U.S. 549). בית המשפט קבע כי אין מכוח החוקה סמכות לממשל הפדרלי לחוקק חוק זה, וכן אין הוא נופל בגדר פסקת המסחר. פסק הדין לא איזכר תיקון זה לחוקה.
