@MordechaiLando: Unfortunately, I do not speak any Hebrew. However, if I may, I will answer your points in English. Possession and ownership of an image or the equipment used to take the photo does not equate holding the the copyright. The copyright holder is the person who took the photo, unless transferred by operation of law or by contract (According to the Copyright Act, Art. 37 Para. (c) Copyright transfer must be written) As such, while you may own the tangible embodiment of the work, the intangible intellectual property belongs to the bystander, and we would require permission and a specific release under an acceptable free licence from the photographer for the image to be hosted on Wikimedia projects. For personal use not on a Wikimedia project, your use of the image is not a problem as there would be most likely an implied/implicit licence. However, for uses on Wikimedia projects, photos of living persons generally must be under a free licence and with permission of the copyright holder (the photographer). If you daughter is the photographer as you stated on Wikimedia Commons(commons:Special:Diff/426837010), then she will need to send permission and a specific release under a free licence using OTRS. Thank you for your understanding.

Nevertheless, just imagine that John walks near a lake with a girlfriend and handles his smartphone to a walking by stranger requesting him to capture a nice frame of the couple with the lake as a background. The captured image could never be loaded to commons according to your message. That's a narrow literal interpretation of copyright law. Essentially, the stranger captured the frame as John's long arm or envoy, and thus has no copyright by law, similarly to an employee capturing photos for an employer.

Thank you for your message. Unfortunately the interpretation of copyright law that you hold is incorrect. The employer-employee relationship is clearly defined by copyright law in Israel and also generally by contract--per the Copyright Act: "The employer is the first owner of copyright in a work made by an employee in the course of his service and during the period of his service, unless otherwise agreed." A stranger on the other hand is not an employee and, as the author, retains the copyright. Please note that all works, unless explicit exempted by the law or by case law, is assumed to be copyrighted. Thank you for your understanding.
